123Mountain evicted for second time (slideshow)

The Summit County Sheriff’s office evicted local outdoor retailer 123Mountain on Thursday afternoon. The eviction was carried out after plaintiff Condos Off Main was granted a court order for a writ of restitution on Monday, March 28. The owners of the store, Olivier and Anna Sofia Goumas, reportedly had not paid rent since November.

The 2,500 square-foot store was emptied that afternoon, with the remaining shelves and inventory cleared out and taken into storage. The details of a future Sheriff’s Sale have not yet been determined. Most of the store’s inventory was previously seized to pay a debt to a web design and marketing company that was never compensated for revamping 123Mountain’s website.

Colorado Attorney General Cynthia Coffman was also awarded an ex parte motion for a temporary restraining order and asset freeze against 123Mountain on Monday, with an evidentiary hearing set for a preliminary injunction set for April 6 in the Summit County District Court. Under these terms, 123Mountain may no longer conduct online business, or dissipate their assets or funds.



The locks to the Goumas’ old store have been changed, and they will no longer have access to the building, located one block off of Frisco’s Main Street. The couple was evicted just one year ago from their store at the base of Copper Mountain, after having failed to pay two months in rent. 123Mountain currently has an “F” rating by the Better Business Bureau, with more than 90 consumer complaints against the company for undelivered items, problems with returns and failure to issue refunds.
