District Attorney dismisses failure to report child abuse charges against 2 Summit School District employees

About two years after several Summit School District employees were charged with failure to report child abuse, all four cases have reached a resolution.
Attorneys representing former Summit Middle School Principal Greg Guevara and Summit Middle School counselor Maureen Flannagan have confirmed that the 5th Judicial District Attorney’s Office in March dismissed the three charges of failure to report child abuse that each faced.
Meanwhile, former human resources director Grant Schmidt has received a deferred judgement and sentence after pleading guilty earlier this year to a single count of failure to report child abuse, according to court documents. A human resources specialist also received a deferred judgement and sentence after pleading guilty to failure to report child abuse in January 2024.
A grand jury originally indicted all four school district employees on a single charge of failure to report child abuse or neglect, a Class 3 misdemeanor, in March 2023. The indictments came six months after the arrest of a former middle school physical education teacher on felony sexual assault charges in August 2022.
The failure to report child abuse charges alleged that the school professionals failed to act as required by the state’s mandatory reporter laws on allegations students raised about the former teacher. A jury trial in September 2023 acquitted the former physical education teacher of all charges.
Last November, a Summit County judge dismissed the failure to report charges against Guevara, Flannagan and Schmidt due to a flawed indictment. Then, the District Attorney’s Office filed three new charges of failure to report child abuse against Guevara and Flannagan and two counts of failure to report child abuse against Schmidt.
Defense attorneys J.B. Katz and Tim Bussey, who represent Guevara and Flannagan, respectively, each said that their clients have maintained their innocence since the original charges were filed two years ago.
“He asserted his innocence the entire time. We’re happy the district attorney’s office finally acknowledged that,” Katz said of Guevara. “He loves Summit County and has every intention of staying here and being a contributing member of the community.”

Bussey described Flannagan as a “longtime, well-respected counselor” and “an excellent employee” of the school district. He credited the District Attorney’s Office with taking a fresh look at the case and determining not to proceed, “after all these months of this case hanging over Ms. Flannagan.”
“It’s important to know that charges like this are very difficult and challenging for an educator, especially in a lower level position like Ms. Flannagan,” Bussey said. “She was respected and well-liked by many, if not all. This was a burden she shouldn’t have had to carry, but we’re grateful that justice was served and the case was dismissed.”
Flannagan remains on administrative leave with the school district through June 16, at which point her contract and employment with the school district ends, according to Summit School District communications director Kerstin Anderson.
Schmidt pleaded guilty to the charge of failure to report he was facing and received a three-year deferred judgement and sentence, according to court documents filed in his case March 3. A second count of failure to report child abuse was dismissed as part of his plea, the documents state.
Schmidt will be required to complete 20 hours of public service and 20 hours of other service, focused on victim empathy and mandatory reporting, as a condition of the deferred judgement and sentence, according to court documents.
A deferred judgement and sentence means that the charge will be dismissed at the end of the three-year period so long as he completes the required conditions and does not commit any new crimes during the period.
Attempts to reach Schmidt and his attorney were unsuccessful. The District Attorney’s Office also did not return a request for comment.
