Chris Hoover: CDOT dodges pothole damage responsibility

I had an accident on May 17 on Hwy. 9 in which my front tire was

blown out and my rim was split down the middle. I followed protocol and:

1. Called the state police and filled out an accident report;

2. Got an official quotation from the Volvo Dealer to replace the rim;

3. Filed a damage claim with CDOT on their “Pot Hole Claim Web Page”

I was very confident I would be compensated 100 percent for my damages.

However, I was amazed to receive a letter from CDOT’S legal firm which stated: “In order for the State to be liable for damages, they must have had prior notification that a problem exists, and failed to act with a reasonable amount of time to fix the problem.” The lawyer then mentioned that “The Government Immunity Act” covers the state and prohibits tax payers from collecting anything from them under this situation.”

I am calling out to the tax payers of Summit County and beyond, to contact the Summit Daily if you would like to help with this cause. If you had previously filed a report about this area or pot hole, I am looking for some help. This is not about the money, this is based totally on principle and the fact that our state and our country is obviously not allocating our tax revenues appropriately, and I for one am fed up with it! I am betting it is the state’s practice to deny all claims under this act, based on the lawyers obvious bias actions to protect the state’s interest at all causes.
