Company hoping to revive Ski Train sues Amtrak

DENVER – A company hoping to revive Colorado’s Ski Train is suing Amtrak for making “unforeseen demands” which jeopardize the passenger train service that is scheduled to start Sunday.

A court hearing is scheduled Wednesday.

The popular Ski Train from Denver to the Winter Park ski area shut down last year after the Anschutz Co. sold the train’s cars.

Chicago-based Iowa Pacific Holdings LLC started negotiating with the track’s owner, Union Pacific Railroad, so a new service could use the same route. It was negotiating with Amtrak for crews.

Amtrak said Tuesday that talks were at an impasse because of issues including staffing requirements and liability, and that it hadn’t gotten notice that Iowa Pacific complied with all federal rail safety regulations.

Iowa Pacific said Amtrak imposed new contract liability and insurance requirements. It said it has followed all regulatory compliance requirements of the Federal Railroad Administration and was in the process of inspections when talks with Amtrak stalled.

The new Ski Train started selling tickets in November, though an Iowa Pacific official said at the time that it was awaiting final approval from Amtrak. More than 13,000 people have already made reservations through March, the company said.

It said it would announce a system for exchanges or refunds if the train has to delay or cancel its season.
