Dillon: Preliminary injunction in Adriano’s case denied

The plaintiffs in the case against Adriano’s Deli and Bistro in Dillon were denied a preliminary injunction request recently, in which they requested the restaurant be ordered to stop playing its music before trial.

Judge Mark Thompson denied the request, and asked that the two parties schedule a mediation before Nov. 1. If their issues aren’t resolved during the sit-down, the case will go to trial.

Eight Dillon residents filed suit against the restaurant earlier this summer, claiming the live music on the restaurant’s new 130-foot deck has become “an extreme annoyance and nuisance to the plaintiffs who are neighboring residents,” and interferes with their use of their properties, according to the suit, filed against Adriano’s and its owner, Ivano Ottoborgo.
