Elaboration needed on Amendment 34

Some elaboration is needed on your Aug. 22 article headlined, “Summit builders join fight against new construction liability proposal.” While homebuilders wholeheartedly believe homebuyers should be protected against shoddy construction, Amendment 34 would force some homebuilders, contractors and subcontractors out of business. Because Amendment 34 would allow unlimited damage awards in a construction-defect case, the only way for a homebuilder’s insurance company to protect themselves against sky-high damage awards would be to raise general-liability insurance rates or drop homebuilder policies altogether. No matter how you look at it, this means higher housing costs. Amendment 34 also would eliminate some of the toughest accountability measures ever designed to get a homebuilder to quickly resolve a homeowner’s construction-defect concerns to avoid a lawsuit. If a homebuilder makes a mistake, he would like a chance to fix it quickly and to everyone’s satisfaction. Current law allows that, and the fact that construction-defect lawsuits have gone way down proves that. Not only would this amendment affect homebuilders, but it also implicates vendors, sub-contractors, realtors and homeowners involved with almost any and all construction projects. We don’t need to clutter the state constitution with an amendment that will only hurt Coloradans in the long run.
