“Senate blocks DADT.” “House threatens to block tax deal.” “Dream Act blocked.” For all you “better than we” strict constructionists and smug liberal purists out there, answer this: Where in the Constitution of the United States does it say that the business of the country must be determined by a supermajority – a 60 percent vote? The individual license (not a right) to “filibuster” by “rule of the body,” nowhere having been passed as an “act” that has been signed by the president or approved by the supremes has become the collective “Filibuser” by fiat of the elected representatives. The “Gentlemen” and “Gentlewomen” of the Lame Duck 111th Congress and the prospect of similar in the 112th Congress, have turned that historic institution into a mockery of Constitutional jurisprudence. If I had an employee who produced nothing, I would pay that person nothing. Due process means more than not making substantive decisions in Congress based on “rules of procedure” rather than the law of the land.
