Judge allows statements of man accused of assault

BRECKENRIDGE – A Silverthorne man accused of fondling an 11-year-old girl will have his own statements used against him following the ruling of a judge Tuesday.

Silverthorne Police arrested Felipe Lechuga Barrera, 26, on April 16 after witnesses called 911. Officers scoured three Silverthorne trailer parks before locating Barrera near his home at the Cottonwood trailer park.

According to statements from witnesses – including the victim – reported by officers in court documents, Barrera grabbed and fondled the partially undressed victim as the two stood at the banks of the Blue River waterway running through the neighborhood.

Officers arrested Barrera, who lives next door to the victim, and took him to the police department, where, through an interpreter, he told a detective he put his hands down the unzipped pants of the girl, according to the documents.

In the court proceedings this week, Barrera’s attorney, Al Cabral, argued that, because of the language barrier and because his client’s rights weren’t fully explained to him, Barrera’s statements should not be admitted as evidence. Judge David Lass disagreed.

Barrera faces a fourth-degree felony charge of sex assault on a child. The crime carries a possible two- to eight-year prison sentence. He is scheduled for a hearing Sept. 2 to determine if a trial or sentencing will be held.
