Man killed while delivering divorce papers in Loveland

LOVELAND ” A Loveland man has been accused of fatally bludgeoning a process server who had just given him divorce papers and then choking his children into unconsciousness.

The 10- and 12-year-old children remained hospitalized Thursday, one day after the attack, but their conditions had not been released.

The Larimer County Sheriff’s Department said 45-year-old James Scott Whitler was being held without bail on charges of murder, attempted murder and child abuse.

Whitler’s attorney, Eric Vanatta, said he had no comment.

Sheriff’s spokeswoman Eloise Campanella said the victim, Stephen D. Allen, 57, had taken the divorce papers and a restraining order to Whitler’s home in Loveland, about 45 miles north of Denver.

Witnesses told investigators that Whitler left the room, then returned and beat Allen with a baseball bat, Campanella said.
