Vieira hearing set for April 2
February 26, 2008
SUMMIT COUNTY ” The preliminary hearing for Joao Paulo Vieira, a Breckenridge resident being charged in connection with an alleged sexual assault on Feb. 12, has been set for April 2.
According the District Attorney Mark Hurlbert, Vieira appeared in court last Friday to set the date for the preliminary hearing and was given a set of guidelines to abide by until his next appearance in court.
“He has to stay in state, stay out of trouble, appear at his court date, and have no contact with the victim,” said Hurlbert.
The April 2 hearing will look to determine probable cause in the case and will include witness testimonies.
“All the evidence will be put forward and if the judge does find probable cause then the case will be bound over to the district court,” said Hurlbert.
Vieira is being charged with 1st degree sexual assault, a class 3 felony. If convicted Vieira could be facing a fine of $3,000 to $750,000 and prison time of 4 to 12 years.
