An affidavit written by a Dillon Keystone Police Department officer provided more details about the department’s May 24 arrest of a 25-year-old man on charges including attempted murder.

Officers arrested Ernesto Camacho after responding to Elevation Bowl around 1 a.m. May 24. Two parties had reported hearing 10 or more gunshots and provided a description of a suspect’s clothing, which matched what Camacho was wearing that night, according to the affidavit. The Fifth Judicial District Attorney’s Office has filed formal charges against Camacho, which include four felony counts of attempted murder in the second degree, four misdemeanor counts of reckless endangerment and one misdemeanor count of prohibited use of a weapon.

When officers first responded, they found another man in the parking lot across from La Riva, the building which houses Elevation Bowl. They detained that man, who according to witness testimony was involved in an argument with Camacho earlier in the night. While escorting that man to a patrol vehicle, officers saw Camacho in the passenger seat of another car, wearing clothing matching the reporting parties’ description of the suspect.

As officers approached Camacho, they saw a gun in the cupholder of the car, according to the affidavit. They ordered him out of the car, and he complied and was taken into custody with no issue. Outside the front passenger door of the car sat a black cowboy hat, which was part of the reporting parties’ description of the suspect. Officers observed bullet casings around the cowboy hat.

Officers removed the gun from the cupholder, finding it was empty and locked to the rear, indicating the last round had been fired, according to the affidavit. Upon further inspection, officers found a second firearm on the ground of the front passenger seat, which was also locked to the rear and empty.

An officer spoke to three people identified in the court record as victims, and they told police they had gone to Elevation Bowl’s nightclub space for its Latin Night. When they arrived, a man matching Camacho’s description started talking to a woman in their group, but she told him that her boyfriend was getting her a drink. When the boyfriend, who was the man police originally detained, came back to the group, he and Camacho got into an argument. The victims told police that club bouncers broke up the altercation, according to the affidavit.

When the group later left the club, according to their testimony in the affidavit, a man largely matching Camacho’s description followed them outside. They stood by one of their cars and heard gunshots but did not see the shooter, so they got in the car and left.

Another witness told police they had gone to La Riva to pick up some of their friends, according to the affidavit. They were in the parking lot when a man in the car next to them started shooting, so they ducked down in their seat until the shots stopped.

Officers observed bullet holes in the side of a car in the parking lot that was next to the victim’s car, the affidavit stated. Officers counted 26 shell casings at the scene, noting that there were two calibers, which matched the two guns found in the car in which Camacho had been sitting. The affidavit stated that Camacho told police he owned the two guns but had not fired them for about a week. Officers tested his hands for gunshot residue, and the test returned a presumptive positive. The officers took another sample to send to the Colorado Bureau of Investigation for further analysis.

The affidavit described the charges on which officers arrested Camacho, and it stated he fired around 26 rounds in the direction of the victims’ vehicle, but the neighboring car had blocked the shots. If it had not been there, the affidavit stated, the victims could have been seriously injured or killed.

The description for the prohibited use of a firearm stated Camacho was intoxicated during the incident.

A court set Camacho’s bond at $100,000 cash or surety on May 25, according to court records. Jail records show he remains in custody, and his next court appearance is scheduled for June 16 at 1:30 p.m. in Summit County Courtroom G.
