Breckenridge man arrested for sexual exploitation of a child

Law enforcement officers arrested James Evans Fleming on Aug. 18 for charges of sexual exploitation of a child.

Summit County Sheriff’s Office deputies arrested a 76-year-old Breckenridge man Aug. 18 on charges of sexual exploitation of a child following an investigation.

Law enforcement received tips from the International Crimes Against Children Task Force about an internet user in Breckenridge uploading child sexual abuse images to the internet. The IP address associated with the uploads was registered to James Evans Fleming, according to an affidavit filed in court.

Fleming’s Wi-Fi network was not password protected, according to the affidavit, so deputies spoke with him at his residence in May. Fleming reportedly told deputies he did not know if his Wi-Fi was password protected, but he was the only person living in his residence and the only one he knew of using his Wi-Fi.



Deputies reportedly asked Fleming about the child sexual abuse images, defining what constituted as such. The affidavit states Fleming admitted to downloading sexual images, but not ones of children.

During the investigation, deputies determined there was probable cause that Fleming was in possession of child sexual abuse images and secured his residence. The affidavit states deputies seized 13 electronic and storage devices.



On July 31, deputies received a signed search warrant to search eight of Fleming’s devices. In August, they found images that matched ones from the task force tips, as well as other images of the same subject.

The 5th Judicial District Attorney’s Office filed a complaint against Fleming listing seven charges of sexual exploitation of a child. He is scheduled for a preliminary demand hearing on Oct. 15 at 1:30 p.m., and he posted bail the day of his arrest, according to Sheriff’s Office Lt. Mike Schilling.
